1. Who these terms are between
These terms are an agreement between you and the business that operates ThrowBlankets at throw-blankets.com. In these terms, "we," "us," and "our" mean that business. "You" means the person using the site or placing an order.
By using this website or placing an order, you agree to these terms. If you do not agree, do not use the site.
2. Who can buy from us
You must be at least 18 years old to place an order. If you are under 18, a parent or guardian must place the order for you.
You must give us accurate information when you order, including a shipping address you can receive deliveries at.
3. The designs on our blankets
Every design in our store is original and belongs to us. We own the copyright in the artwork, and we own the ThrowBlankets name and logo.
When you buy a blanket, you own that blanket. You do not receive any right in the design itself. You may not copy, reproduce, scan, redraw, or use our designs on any product, whether or not you sell it. You may not use our artwork, photographs, or product images for your own commercial purposes without our written permission.
You are welcome to photograph a blanket you own and post it on social media. That is not a commercial use, and we are happy to see it.
If you believe one of our designs infringes your rights, write to us at support@throw-blankets.com with the details and we will look into it.
4. Prices
All prices are shown in US dollars and include the cost of the product. Shipping and any applicable tax are shown separately at checkout before you pay.
We can change prices at any time. The price that applies to your order is the price displayed when you place it.
We try to keep the store accurate, but if a product is listed at an obviously wrong price because of a technical or human error, we may cancel the order and refund you in full rather than fulfill it at that price. We will tell you before we do.
5. How an order is formed
Placing an order is an offer to buy. Our order confirmation email acknowledges we received it. The contract between us is formed when we send you the shipping confirmation email for that order.
We can refuse or cancel an order, including after the confirmation email, if the product is unavailable, if we suspect fraud, if the shipping address is one we cannot deliver to, or if the order appears to be for resale. If we cancel, we refund you in full.
We can limit the quantity of any product sold to one customer or one address.
6. Payment
Payment is taken at checkout by our payment provider. We do not store your card details.
You confirm that you are authorized to use the payment method you enter, and that the billing information you give us is correct.
7. Product descriptions and colors
We describe our products as accurately as we can and we photograph them honestly.
Screens vary. The color you see on your phone or monitor may differ slightly from the blanket that arrives. Measurements are approximate and may vary by up to 1 inch.
8. Shipping
Our Shipping Policy explains where we ship, how long delivery takes, and what happens if your order is delayed. It forms part of these terms.
9. Returns, replacements, and refunds
Our Refund and Replacement Policy explains what we do if your order does not arrive, arrives damaged, or is not what you ordered. It forms part of these terms.
Nothing in these terms removes any right you have under consumer protection law that cannot be excluded by agreement.
10. How you may use this website
You may browse the site, place orders, leave a review of a product you bought, and contact us.
You may not attempt to access parts of the site that are not public, interfere with how the site runs, scrape or copy the site in bulk, upload anything harmful, impersonate anyone, or use the site to break the law.
We can suspend your access if you do any of these.
11. Reviews and content you submit
If you send us a review, a photograph, or any other content, you keep ownership of it. You give us permission to use it on our website, in our emails, and on our social media, without payment, to show how our products look in real homes.
You confirm that the content is yours to share, that it reflects your genuine experience, that it does not include anyone who has not agreed to appear, and that it does not infringe anyone's rights.
We do not remove a review because it is negative, and we do not offer anything in exchange for a positive review. We remove content that is abusive, unlawful, off topic, posted by someone who did not buy the product, or that infringes someone's rights.
You can ask us to remove a review you posted at any time by writing to support@throw-blankets.com.
12. What we do not promise
We provide this website as it is. We do not promise it will always be available, error free, or free of interruption, and we do not promise that any defect will be corrected immediately.
To the fullest extent permitted by law, we exclude all implied warranties in relation to the website itself. This does not affect any guarantee that applies to the products we sell.
13. Our liability
To the fullest extent permitted by law, our total liability to you in connection with any order is limited to the amount you paid for that order.
We are not liable for indirect or consequential loss, including lost profit, lost opportunity, or loss of data.
Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Nothing in this section removes any right you have under consumer protection law that cannot be excluded by agreement.
14. Force majeure
We are not responsible for delay or failure to perform caused by something outside our reasonable control, including carrier disruption, extreme weather, strikes, fire, flood, power or network failure, epidemic, war, or government action.
If such an event delays your order, section 4 of our Shipping Policy applies and you can cancel for a full refund.
15. Governing law and where disputes are heard
These terms are governed by French law.
Any dispute between us will be heard by the courts of France, unless the consumer protection law of your country of residence gives you the right to bring the claim in your own courts, in which case that right applies.
16. If part of these terms does not hold
If a court finds any part of these terms unenforceable, the rest stays in force.
If we do not enforce a right immediately, we have not given it up.
17. Changes to these terms
We may update these terms. When we do, we will change the "Last updated" date at the top of this page. The version in force when you place an order is the version that applies to that order.
